I. General provisions
The general terms and conditions below apply to sales by ROCK STAR CONSTRUCT S.R.L. (referred to below as the “Seller” or “RockStar”), through the online store/website piatraonline.com, to the Buyer – an individual or a company, as applicable (referred to below as the “Buyer”) – of the goods listed on the Seller’s website, as well as to the related services provided by the Seller (e.g. delivery services). The goods sold through this website are referred to below as the “goods” or “products.” By entering into the distance-selling contract (checking the box “I have read the PIATRAONLINE Terms and Conditions” before placing or paying for an order) with the Seller, the Buyer expressly declares that they accept the terms and conditions below and agree to abide by them. Accessing, using, or browsing this website by any visitor or user implies acceptance of the terms and conditions set out below.
II. Description of goods/products
All descriptions, specifications, advertisements, images (both printed and on the Seller’s website), and samples sent by courier or handed over at the Seller’s showroom are provided for informational purposes and are intended to give an approximate representation of the products. They cannot be treated as a 100% accurate reference, since the products to be delivered are made of natural stone, and variation in color, texture, markings, and dimensions between batches of stone is normal for these products; such variation cannot be directly controlled by the Seller or its suppliers.
Given the nature of the products (natural stone), the Buyer expressly declares that they have been informed of, and accept, the following:
all descriptions, images (both printed and online), and samples sent by courier or handed over at the Seller’s showroom can only provide an approximate representation of the products;
since the products are natural, there is geological variation between batches in color, markings, texture, and size;
all types of natural stone are porous to some degree and must be sealed as appropriate;
some products can scratch or chip easily, so extra care must be taken when handling and transporting natural stone;
the percentage of chips or breakage in an order may be up to 5%, calculated on the quantity delivered, without the Seller being required to pay any damages or compensation or to refund or pay any amount to the Buyer. If the percentage mentioned above is exceeded, the Seller agrees to replace the broken or damaged products beyond that 5%, where the damage is attributable to the Seller.
III. Prices:
The prices shown are based on the current cost of the products sold and do not include VAT. VAT is added when the order is placed on the Seller’s website, in line with the law in force at the time of the order. No product’s price includes delivery. Delivering products to the address given by the Buyer will be charged separately, with VAT applied. The Seller reserves the right to change the prices shown on the website without prior notice. However, the Seller will never change the price of an active order for which a deposit has been received from the Buyer. If the price of ordered products for which no deposit has been received changes, the Seller will send a notice informing the Buyer, who may withdraw by notifying the Seller within 48 hours of receiving the price-change notice.
For atypical/templated special pieces, an additional charge of 40% of the order cost applies (an atypical/templated piece is one that isn’t square or rectangular – an order that the Seller normally enters into a spreadsheet, based on which the piece is cut in the workshop).
The price of an ordered product is the one shown when the Seller confirms the order, and is valid for 24 hours from that communication. To keep the reservation valid, the Buyer agrees to pay the deposit within that validity period. Otherwise, the reservation will be canceled and the goods returned to stock, available for sale. The price communicated when the order is confirmed will include all applicable charges, as well as the cost of shipping, if shipping through the Seller is requested. Shipping cost is listed separately on the order/pro forma invoice.
A. Payment
Orders are always paid in full before delivery/pickup from the showroom or warehouse. For products not in the Seller’s stock that are part of a special order (with a delivery lead time), the Buyer will pay a 40% deposit of their price when placing the order, and pay the Seller the remaining balance at least two (2) days before the announced delivery date. Payment by the Buyer into the Seller’s bank account will only be considered valid once the corresponding amount is received in the Seller’s account.
B. Availability of goods/products
If goods are in stock at the Seller’s warehouse, they will be released from the warehouse for delivery within 2 business days, not counting the day the order was placed. Delivery time depends on the delivery method chosen by the Buyer. If the Seller’s goods are out of stock for any reason, the Seller will notify the Buyer and inform them of an estimated date when the products will be available for delivery. The Seller will not be held liable and will not owe any damages or compensation to the Buyer where products aren’t available for delivery at the time the order is placed.
IV. Technical steps for concluding the contract
Using the categories and subcategories menu, the Buyer browses until they find the product that fits their needs. Products can also be searched for using the search field.
A. Selecting a product: To add a product to the shopping cart, click “add to cart.” After adding a product to the cart, the Buyer is redirected to the shopping cart, where they can update the quantity or remove products. The delivery cost is automatically added to the order total. Shipping cost varies depending on the delivery method chosen and the destination.
B. Submitting the order: If they already have an account, the Buyer can log in with their email address and password. If they don’t have an account, they can create a new one or choose “submit order without registering” – a quick checkout.
C. Billing: The Buyer fills in their billing details, with the option to order as an individual, a company, or an association. If the billing address differs from the delivery address, they uncheck the option “Billing details are the same as delivery details.”
D. Choosing a delivery method: There are three options: delivery via our own fleet and partners; courier delivery for certain products selected by the Seller; pickup from the PIATRAONLINE showroom/warehouse at Aleea Teișani 137A, Sector 1, Bucharest.
E. Choosing a payment method: Cash on delivery for courier shipments; online by card, at checkout or via a payment link; bank transfer; card payment at the Bucharest showroom; cash at the Bucharest showroom, within the legal limits in force (Law 70/2015, as subsequently amended). The Seller will issue an invoice for the goods delivered.
F. Finalizing the order: After choosing the delivery and payment method and checking “I agree to the terms of the distance contract…,” the Buyer clicks “Submit order.” They’ll receive a confirmation email that the order was received, then a confirmation email once it’s processed. Any order confirmed by the Seller creates a distance contract between the Seller and the Buyer. For an individual, the distance contract is formed – and for a company, the sales contract is formed – at the moment the Buyer receives the Seller’s confirmation message.
V. Business hours. Delivery.
Orders can be placed online 24/7, but processing takes place Monday to Friday, 8:00 AM – 6:00 PM. Orders placed on Saturdays, Sundays, and public holidays are processed the next business day. Business hours are 8:00 AM – 6:00 PM, Monday to Friday.
A. Delivery time:
for local deliveries (Bucharest-Ilfov): 1-2 business days
for deliveries within Romania: 2-3 business days
for deliveries to Europe: 5-7 business days
Payment must be made at least 2 days before the desired delivery date for Bucharest-Ilfov deliveries, at least 4 days before for deliveries elsewhere in Romania, and for exports, 5-14 days before, depending on the country.
Shipping costs are calculated based on tonnage. For consolidated shipping (orders under 3.5 tons), delivery takes place within 2-3 days of payment, grouped together with other orders. For a full-load shipment (3.5 tons), delivery is made exclusively for that customer (1-2 business days). If a customer needs urgent delivery but has a consolidated-shipping rate, they’ll need to pay the difference up to the full-load rate. For a delivery larger than 3.5 tons, a single delivery note is NOT issued; instead, as many delivery notes as needed are issued. The Buyer is automatically considered late in their obligation to take delivery of the goods after: 5 business days, for both in-stock goods and special-piece orders. If, for reasons attributable to the Buyer, delivery doesn’t happen by the due date, the Buyer agrees to pay 0.5% of the order’s total value per day of delay, as a contractual penalty.
B. Hours. Technical conditions: All deliveries are made using heavy-tonnage vehicles, starting at 1 ton. The Buyer is solely responsible for ensuring the products can be brought onto their property at delivery. Packaging may be modified by the operations department to protect the integrity of the goods. Deliveries are made Monday to Friday between 9 AM and 6 PM. The Buyer agrees to inform the Seller of any access restrictions. The Buyer must ensure an authorized person is present at the delivery address. Delivery staff are not required to handle the delivered goods themselves. If the location doesn’t allow for unloading, the Buyer agrees to pay the cost of the round trip plus the cost of a subsequent delivery.
Unloading: Please note that unloading products will require sufficient personnel, depending on the quantity ordered. For larger quantities, the site must be properly organized and suitable unloading equipment must be arranged.
C. RECEIVING THE GOODS: Goods are inspected both at loading (pickup from the showroom) and at unloading (delivery to the address). On the delivery date, the technical condition of the goods is checked; both parties sign the invoice and packing list. For damaged/missing products, this is noted on the Packing List, and the Buyer does not accept unloading of damaged products without first notifying the Seller and sending photos. The Seller agrees to replace damaged/missing products within approximately 15 days of the issue being identified (for in-stock products). Any defect/shortage must be identified at loading/receipt of the goods; claims made afterward are not accepted. Products weighing more than 30 kg will be loaded EXCLUSIVELY by machine. The accepted rate of minor chips/breakage/scratches is between 1 and 5% maximum of the quantity delivered. Products with variable free length (L.L.) may range from 5 cm to 60 cm in length.
VI. Promotions are valid for the limited time periods stated on the presentation page and while stocks last. RockStar cannot be held responsible for damage caused by information published in error. RockStar reserves the right to add to and/or change any information without prior notice.
V. Confidentiality (section renumbered on the page)
The Buyer will not disclose to any third party any private information received from the Seller. The Seller reserves the right to use the information provided to fulfill the distance contract. Personal information will only be used to complete the order, prepare delivery, and inform the Buyer about special offers or new product ranges.
VII. Transfer of ownership
Ownership of the products transfers on the date the Seller receives payment, while risk transfers on the date of actual handover to the Buyer.
VIII. Exercising the right of withdrawal. Accepting goods and return policy
An individual Buyer has the right to notify the Seller in writing that they’re withdrawing from the purchase, with no penalty and no reason required, within 30 calendar days of receiving the product; this applies only to individuals, for products ordered and purchased online (whether delivered or picked up from the showroom). The returned product must be in the same condition it was delivered in (original packaging, accessories, documents). The Buyer bears the additional costs of the return. Returns must be made within 30 calendar days of the delivery date, based on the return form (sent no later than the 30th day). Refunds are issued within 14 calendar days of the products being physically received at the RockStar warehouse, to the bank account provided in the Return Form. The refunded amount will equal the price paid minus shipping and delivery costs.
The following products cannot be returned: those beyond the 30-day window; products from the Special Pieces range (steps/window sills/countertops); products that match the order’s technical specifications; products that were part of a special order; products from a final stock clearance sale with a discount; products purchased from the showroom with accepted defects and a discount; products that were distinctly customized; products made to the Buyer’s specifications; products showing signs of impact/damage; products showing visible signs of wear. Products must be returned in their original packaging, with all accessories and the original label intact. Return conditions don’t apply to products picked up directly from the shop/showroom (inspected on the spot). Returns must be made in full for a given line item; partial returns of a single invoice line item aren’t accepted.
IX. Force majeure
Neither Party will be liable for failing to perform its obligations due to force majeure. The Party invoking force majeure must notify the other Party within 5 days. If its effects last longer than 90 days, either Party may unilaterally terminate the Contract without penalty.
X. Disputes. Governing law
Disputes will be resolved amicably; failing that, by the competent courts in Bucharest. Complaint resources: www.anpc.ro; email [email protected] (response within 48 hours maximum, excluding weekends and holidays); goods return form; resolution
of disputes online (webgate.ec.europa.eu/odr).
